These Terms and Conditions ("Terms") govern your access to and use of the MnBaladna website (mnbaladna.com), mobile application (the "App"), and all related services (collectively, the "Platform") provided by MnBaladna ("we," "us," or "our"). By accessing, browsing, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform. These Terms form a legally binding agreement between you ("User," "you," or "your") and MnBaladna.
Geographic Scope: The Platform is intended for users in the Netherlands, covering 371 regions, including major cities such as Amsterdam, Rotterdam, The Hague, and Utrecht. Services are provided in compliance with Dutch and EU laws, including the General Data Protection Regulation (GDPR), the Consumer Rights Directive (2011/83/EU), and the Dutch Civil Code (Burgerlijk Wetboek). We reserve the right to restrict access outside the Netherlands.
Acceptance of Terms: By creating an account, placing an order, or using any service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an entity, you represent that you have authority to bind that entity.

The Platform facilitates a wide array of services, from ordering fresh groceries and ready-to-eat meals to custom products like personalized apparel or printed items. As a multi-vendor marketplace, we act as an intermediary, not a direct seller, ensuring transparency in vendor partnerships and user-vendor interactions. Our commitment to excellence is reflected in every aspect of the Platform, from intuitive app-based ordering to real-time tracking and robust customer support.

As a multi-vendor platform, we partner with vetted local vendors (e.g., restaurants, stores) to ensure product quality and freshness. Vendors are responsible for order fulfillment, including preparation, packaging, and delivery. We enforce strict standards, including NVWA compliance for food safety, to maintain trust. Users agree that interactions with vendors are governed by these Terms and the vendor's listings.
Services may vary by vendor, location, and product type. Perishable items (e.g., fresh foods) are limited to express or same-day delivery to preserve quality. Availability is subject to vendor stock, weather, or unforeseen events. We strive for 99% on-time delivery but cannot guarantee absolute performance.
To use certain features (e.g., ordering, tracking), you must create an account by providing accurate information, including name, email, phone number, and address. You agree to:
You are solely responsible for all activities under your account. We reserve the right to suspend or terminate accounts for violations of these Terms, including fraudulent activity or repeated misuse. Inactive accounts may be deactivated after 12 months of inactivity, with prior notice via email.
You must be at least 18 years old to create an account and use the Platform. By registering, you confirm eligibility and compliance with applicable laws. Minors under 18 may use the Platform only with parental consent and supervision.
Orders are placed via the Platform by selecting items from vendor catalogs, adding to cart, and confirming at checkout. You agree to review order details (e.g., price, delivery options) before finalizing. Orders are binding once confirmed, subject to availability and these Terms.
We accept secure payments via credit/debit cards (Visa, Mastercard), digital wallets (e.g., Apple Pay, Google Pay), and bank transfers. All transactions are processed through PCI DSS-compliant gateways. Prices include VAT (BTW) as per Dutch law; additional delivery fees are displayed at checkout (e.g., €5-15 for standard/express, free above €9.99 minimum order).
Payments are encrypted using SSL/TLS. We do not store full card details; tokenized data is used for recurring transactions. In case of payment disputes, contact your bank or us within 7 days. Refunds for cancellations/returns follow our Return Policy (processed within 3-5 business days).
Upon placement, you receive an email/App notification with order confirmation. Changes post-confirmation may incur fees per our Cancellation Policy. Vendors confirm orders within 30 minutes for express items.
Vendors handle fulfillment directly, with options for express (30-60 minutes), standard (1-2 days), same-day, or pickup. Track via the App with real-time updates. Deliveries cover 371 regions; remote areas may incur €2-5 extra fees.
Perishable items require refrigerated packaging and are limited to express/same-day. Custom products may take 2-5 days for processing. We cannot deliver to PO boxes or restricted areas (e.g., certain islands without prior arrangement).
If delivery fails (e.g., incorrect address), we attempt redelivery once free of charge. Subsequent attempts incur fees. Non-delivery due to user error is non-refundable.
Cancellations follow our Cancellation Policy: Free within 30 minutes pre-confirmation; fees (up to 50% for perishables) apply post-confirmation. Process via App or support.
Returns are governed by our Return Policy: 14 days for standard items (EU law); 7 days for perishables if defective. Non-returnable: used/custom/perishable items unless faulty.
Refunds are issued to the original payment method within 7-14 days for approved cases. Partial refunds may apply for partial deliveries. All refunds exclude delivery fees unless due to our error.
You agree to use the Platform only for lawful purposes, respecting vendor listings and other users. Prohibited activities include:
We may suspend/terminate accounts, cancel orders, or pursue legal action for violations. Repeated offenses result in permanent bans. Report violations via help.mnbaladna.com.
Reviews/ratings are user-generated; you grant us a perpetual, royalty-free license to use them. Content must be accurate and non-defamatory; we moderate for compliance.
All Platform content (text, graphics, logos, software, etc.) is owned by MnBaladna or licensors, protected by copyright/trademark laws (e.g., EU Copyright Directive). Vendor content is owned by vendors; you may not use without permission.
We grant a limited, non-exclusive license for personal, non-commercial use. Reproduction/distribution without written consent is prohibited.
Report IP violations via [email protected]. We respond under EU safe harbor provisions.
Your privacy is paramount. We comply with GDPR via our Privacy Policy, covering data collection (e.g., contact info, payment details), use (e.g., order processing), and rights (access, deletion). Cookies are managed per our Cookie Policy. We use Cloudflare for security; data is not sold to third parties without consent.
To the fullest extent permitted by law, MnBaladna is not liable for indirect/consequential damages (e.g., lost profits). Total liability is capped at order value. We disclaim liability for vendor actions or third-party content.
Vendors are responsible for product quality/safety; we facilitate but do not guarantee. Food items comply with NVWA standards; allergies/intolerances are user responsibility.
We are not liable for delays/failures due to events beyond control (e.g., strikes, natural disasters).
These Terms are governed by Dutch law. Disputes shall be resolved exclusively in the courts of Amsterdam, Netherlands.
Before litigation, parties agree to good-faith mediation. For EU users, the EU Online Dispute Resolution platform (ODR) is available at ec.europa.eu/odr.
Submit complaints via help.mnbaladna.com; we respond within 14 days per Dutch law.
We may update these Terms at any time. Significant changes will be notified via email/App (30 days' notice). Continued use post-notification constitutes acceptance. Review the latest version at mnbaladna.com/lang/en/terms-and-conditions.
If any provision is held invalid, the remainder remains enforceable. No waiver of rights unless in writing.
These Terms, plus linked policies (Privacy, Shipping, Return, Cancellation), constitute the full agreement. No oral modifications.
